This Policy explains how Fleet Feet, our affiliates and franchisees collect, use, and disclose personal information about you. This Policy also describes the privacy rights and choices you have with respect to your personal information. What does this Policy cover?
This Policy applies to personal information we collect both online and offline, including when you access or use our websites, including fleetfeet.com and various subdomains thereof (collectively, the “Sites”), access or use our mobile applications, including without limitation Runmoji (collectively, “Apps”), use or interact with our social media presence, shop in our licensed retail stores, attend our events or outings, participate in our training programs, participate in our rewards and loyalty program, contact customer support, or otherwise interact with us (collectively with the Sites and Apps, the “Services”). This Policy describes what personal information we collect or that you may provide when you download, install, register with, access or use our Services including our practices for collecting, using, maintaining, protecting and disclosing your personal information. This Policy also applies to those desiring information about or submitting applications to become franchisees of Fleet Feet.
BY DOWNLOADING, INSTALLING, REGISTERING WITH, ACCESSING OR USINGS OUR SERVICES AND SUBMITTING YOUR PERSONAL INFORMATION TO FLEET FEET OR OUR SERVICE PROVIDERS AND AGENTS, YOU AGREE THAT WE MAY COLLECT YOUR PERSONAL INFORMATION AND YOU CONSENT TO THE USE, DISCLOSURE AND TRANSFER OF YOUR PERSONAL INFORMATION IN ACCORDANCE WITH THIS POLICY AND AS PERMITTED OR REQUIRED BY LAW.
Our Services may contain links to other third-party websites that are not controlled by Fleet Feet. This Policy does not apply to information that you provide to or is collected by such third-party websites, and we are not responsible for the content of such third-party websites or the information practices of such third parties. We encourage you to review the privacy polices of any third parties before disclosing your personal information.
How is this Policy updated?
Fleet Feet may change this Policy from time to time. If we make changes, we will notify you by revising the Reviewed Date above and, in some cases, we may provide you with more prominent notice (for example, by adding a statement to our homepage or sending you a notification), such as in connection with making material changes to this Policy. Your continued use of our Services after we make changes to this Policy is deemed to be your acceptance of those changes. We encourage you to review this Policy regularly to stay informed about our information practices and the choices available to you.
What personal information does Fleet Feet collect?
Information You Provide to Us. We collect information you provide directly to us. For example, we collect information when you register with us; create an online account or profile with us; sign up to receive our emails, coupons, newsletters and other information; make a purchase from us; access or use our Services (including when you write a review or participate in other interactive areas of our Services); sign up for or participate in contests, promotions, our rewards and loyalty program; and other programs, customer experience research, surveys, events, training programs, or outings; engage with us via our social media platforms; apply for employment opportunities; and when you email, call, chat, text or otherwise communicate with us.
The types of information we may collect include your name, address, telephone number, email address, ZIP code, date of birth, photos, videos, social media usernames, demographic information, foot scan information, information about your interests and preferences, the content you post (“User Content”) to the interactive areas of our Services or on social media sites, and any other information you choose to provide to us. If you make a purchase from us, we work with third party payment processors to collect and process your payment information. We may collect information about the purchases you make and return, promotions you engage with or use, points and rewards you earn and/or redeem, data about your use of the points, rewards, and program.
In some cases, we may also collect information you provide about others, such as when you purchase a gift card for someone and request that we deliver it electronically, decide to purchase and ship products to someone, or create and share a gift registry. We will use this information to fulfil your requests and will not send communications to your contacts unrelated to your requests unless they separately engage with us or consent to receive communications from us.
Our Services may include functionality by which you may publish, display or post User Content on public areas of our Sites and Apps. Your User Content is posted and transmitted to others at your own risk. Although our Apps may from time to time permit you to set certain privacy settings, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of third parties with whom you may choose to share your User Content. Therefore, we cannot and do not guarantee that your User Content will not be viewed by unauthorized persons. You represent and warrant that you have the right and authority and have obtained all necessary consents to provide any information, including personal information of another individual that is provided by you to Fleet Feet.
Information We Collect Automatically. When you access or use the Services or shop in our stores, we automatically collect certain information about you, including:
- Transaction Information: When you register with us, make a purchase or return, we collect information about the transaction, such as product details, purchase price, the date and location of the transaction, and the transaction’s relationship to the rewards and loyalty program.
- Device and Usage Information: We obtain information about the device you use to access our Services and your use of our Services, including the type of browser you use, hardware model, operating system and app version, mobile network information, IP address, unique device identifiers, access times, pages viewed, items placed in your cart, links clicked, browsing behavior, and the webpage you visited before navigating to our Services.
- Audio and Video Recordings, Photos, Biometric Information and Chat Content: We capture photographs and video recordings in our stores and other facilities for security and loss prevention purposes. We also capture anonymous foot scan data collected from your voluntary use of our fit id technology in-store. If you contact customer service through our chat feature or by phone, we may monitor and retain those conversations, including for training purposes.
- Third Party Keyboards. Our Apps include a “third party keyboard,” which provides an alternative way to input keyboard data. These keyboards can access all of the data you type, including bank account and credit card numbers, street addresses, as well as other personal and sensitive information. These keyboards may also access nearby text or data, which is useful for improving autocorrect functionality. If you enable “full access” we will be permitted to access, collect, and transmit the data you type. In addition, if we are able to access your location, photos, or other personal information or personal data, we can collect and transmit that information to our servers. If you disable “full access” and then later re-enable full access, we may be able to access, collect, and transmit what was typed while the network access was disabled. If you do not enable “full access,” Fleet Feet will not collect and transmit the data you type. You may choose to disable a “third party keyboard” at any time by visiting your Settings page on your device.
- Precise Geolocation Information: In accordance with your device permissions, we may collect information about the precise location of your device. You may stop the collection of precise location information at any time.
- Information Collected by Cookies and other Tracking Technologies: We (and those who perform work for us) use cookies, web beacons (also known as clear GIFs, web bugs, or pixel tags), and other tracking technologies to collect information about your interactions with our Services, including information about your browsing behavior, purchase behavior, and other engagement with the Services. Cookies are small data files stored on your hard drive or in device memory that help us improve our Services and your experience, see which areas and features of our Services are popular, and count visits. Web beacons are electronic images that we use on our Services and in our emails to help deliver cookies, count visits, and understand usage and campaign effectiveness. Information We Collect from Other Sources. We may also receive information about you from other sources. For example:
- We collect demographic information, and information about consumer preferences, interests, and opinions from data analytics and advertising partners.
- If you create an account or access our Services using credentials from a third-party social media platform (such as Facebook and Instagram), we have access to certain information from that platform, such as your name, email address, friends list, and public profile information, in accordance with the authorization procedures determined by that platform.
- We collect content you disclose publicly in connection with our products, services, or promotions, including photos, videos, and profile information including any information that you post on social media platforms or that is publicly available on social media pages.
- We may collect information about you from other users if they choose to disclose that information with us via the Services, such as if they purchase gifts for you.
Information We Infer or Derive About You. We may derive information or draw inferences about you based on the information we collect. For example, we may infer that you are looking to purchase new running shoes or other products based on your website browsing behavior and past purchases, or we may use your IP address to draw inferences about your approximate location.
What about targeted advertising and analytics services provided by others?
We engage others to provide analytics services, serve advertisements and perform related services across the web and in mobile applications. These entities may use cookies, web beacons, SDKs, device identifiers and other technologies to collect information about your use of the Services and other websites and mobile apps, including your IP address, web browser, mobile network information, pages viewed, time spent on pages or in mobile apps, links clicked, and conversion information. This information is used to deliver advertising targeted to your interests on other companies' sites or mobile apps and to analyze and track data, determine the popularity of certain content, and better understand your online activity. Some of our advertising partners also enable us to translate your email address or phone number into an identifier that can't be used to identify you personally. Our advertising partners then use that unique identifier to show ads that are more relevant to you across the web and in mobile apps.
How does Fleet Feet use your personal information?
We use the information we collect about you or that you provide to us, including any personal information, to:
- provide you with our Services and its content, and any other information, products or services that you request from us or our affiliates, franchisees, or business partners;
- provide, support, maintain, personalize and improve our Services;
- facilitate and improve your in-store and online shopping experience with us, or our affiliates, franchisees, or business partners;
- customize your experience with us;
- administer and communicate with you about your account;
- audit our interactions with you, such as counting impressions or verifying the quality and effectiveness of content including advertisements
- provide, deliver, and develop new products and services, process transactions and returns, and send you related information, including confirmations, receipts, invoices, and customer experience surveys;
- facilitate your participation in rewards and loyalty programs;
- manage your accounts with us, provide technical support (including to debug and troubleshoot), and send you technical notices, updates, security alerts, support messages, and other transactional or relationship messages;
- notify you when updates to are Services are available and of changes to any Services;
- detect, investigate, and help prevent security incidents, fraudulent transactions, and other malicious, deceptive, fraudulent, or illegal activities and help protect the rights and property of Fleet Feet and others;
- debug, identify, or repair errors or effectuate similar functional enhancements in connection with our Services;
- respond to your comments and questions and provide customer service;
- communicate with you about products or services offered by us, our affiliates, franchisees and business partners, and other information we think will be of interest to you (for information about how to opt out of promotional communications, please see the Promotional Communications subsection of the What Are Your Privacy Rights and Choices? section below);
- provide product recommendations based on preferences and biomechanical information, including foot scans with videos or walking and/or running motion data
- comply with our legal and financial obligations;
- conduct recruiting and candidate evaluation activities and to inform our employment decisions;
- monitor and analyze trends, usage, and activities in connection with our Services, stores, affiliates, franchisees, and experiences;
- tailor the content and information that we or others send or display to you, offer location customization and personalized recommendations, help, and instructions, and otherwise personalize your experience while using our Services;
- target advertisements to you on third-party platforms and websites (for more information and to opt out, please see the What About Targeted Advertising and Analytics Services Provided by Others? section below);
- facilitate contests, promotions and sweepstakes, and process and deliver entries, rewards, and prizes;
- evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as party of bankruptcy, liquidation, or similar proceeding; and
- carry out any other purpose conveyed to you at the time the information was collected.
How does Fleet Feet disclose your personal information?
In certain circumstances, we disclose (or permit others to directly collect) information about you. The list below describes when and to whom we disclose the categories of personal information described in the “What Personal Information Does Fleet Feet Collect” section above:
- with our affiliates and franchisees;
- with services providers, vendors, contractors, agents and other third parties we use to complete transactions, perform services on our behalf, and support our business and operations, such as those that assist us with our business and internal operations like administration of a rewards and loyalty program, shipping and delivery, payment processing, fraud prevention, customer service, surveys and market research, gift cards, experiences and events, personalization, data enrichment, analytics, marketing, and advertising;
- when you participate in the interactive areas of our Services (such as by creating a profile, posting comments and other content, or writing reviews), certain information about you may be displayed publicly on our Services and on third-party sites. For example, your photos, videos, stories, posts, comments, product reviews, product questions and answers, and any other content or information you choose to provide in the interactive areas of our Services will be disclosed with users of our Services;
- at your direction, including when you share actions you take on the Services with social media, and vice versa, submit a product review using a third-party service or otherwise direct Fleet Feet to disclose your personal information to a third party;
- in connection with, or during negotiations concerning, any merger or acquisition of all or a portion of our business by another company, joint venture, corporate reorganization, insolvency or bankruptcy, financing or sale of company assets;
- if we believe disclosure is in accordance with, or required by, any applicable law, regulation, or legal process, including lawful requests by public authorities to meet law enforcement or national security requirements;
- if we believe your actions are inconsistent with our Terms of Use or other agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to protect the rights, property, and safety of Fleet Feet, our customers, or any other persons;
- between and among Fleet Feet and any current and future parents, affiliates, and our franchisees; and
- with your consent.
We also disclose aggregated or de-identified information, which cannot reasonably be used to identify you. Fleet Feet processes, maintains, and uses this information only in a de-identified fashion and will not attempt to re-identify such information, except as permitted by law.
Any personal information collected by us through our SMS texting programs will not be disclosed or shared with third parties.
What are your privacy rights and choices?
Account Information. You can access, correct, or delete certain information stored within your online account at any time by logging into your online account.
Promotional Communications. You may opt out of receiving promotional communications from Fleet Feet by following the instructions in those communications. If you opt out of receiving promotional communications, we may still send you non-promotional emails, such as emails about your purchases, account, membership, or our ongoing business relations, including information about your rewards and our initiatives and activities.
Mobile Push Notifications/Alerts. With your consent, we may send promotional and non-promotional push notifications or alerts to your mobile device. You can deactivate these messages at any time by changing the notification settings on your mobile device.
Cookies. Most web browsers are set to accept cookies by default. If you prefer, you can usually adjust your browser settings to remove or reject browser cookies. How Does Fleet Feet Protect the Privacy of Children Online?
As a general rule, our Sites and Services are designed for a general audience and are not directed to children under the age of 13. We do not knowingly collect personal information from children under the age of 13 online. If you are under 13, do not use or provide any information on the Sites or Services or through any of its features, register on the Sites, make any purchases through the Sites or Services, use any of the interactive or public comment features in the Sites or Services, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. Data Security
We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Sites or Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Sites or Services, like message boards. The information you share in public areas may be viewed by any user of the Sites and Services.
Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our Sites or Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.
